Terms of use

INTRODUCTION 

Forgood is a social networking platform facilitating South Africans to “do better and be better” as active citizens in the country.

Forgood reserves the right to update and change the Terms and Conditions from time to time, without notice. Any new features added to the current site, including the release of new tools and resources, shall be subject to the Terms and Conditions. Continued use of the site after any such changes have been made shall constitute your consent to such changes. It is therefore your responsibility to review this document on a regular basis in order to keep up with any alterations made to the site.

ACCOUNT TERMS

·         You must be a human and provide a valid email address and cellphone number on sign up. Accounts registered by 'bots' or other automated methods are not permitted.

·         You are responsible for maintaining the security of your account and password. Forgood cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

·         You are responsible for all content posted and activity that occurs under your account, even when content is posted by others who may be sharing your pages.

·         You may not use the site for any illegal or unauthorised purpose. You must not violate any laws in your jurisdiction, including but not limited to copyright laws.

Violation of any of these agreements will result in the termination of your account.

While Forgood prohibits such conduct and content on the site, you understand and agree that Forgood cannot be responsible for the content posted on the site and you nonetheless may be exposed to such materials. You agree to use the site at your own risk.

COPYRIGHT AND CONTENT OWNERSHIP

·         Members agree that they may not upload content of which they do not have permission to do so, including but not exclusive to, images and text in breach of any copyright or intellectual property laws.

·         We claim no intellectual property rights over the material you provide to the site. Your profile and materials uploaded remain yours. However, by setting your pages to be shared publicly, or amongst pre-defined groups or friends, you hereby agree to allow anyone to view and share your content, and grant Forgood a limited license to use, modify, display, reproduce, and distribute such content solely on and through the Forgood site.

·         Forgood may pre-screen content, but Forgood and its designee have the right, but not the obligation, in their sole discretion, to refuse or remove any content that is provided by you and to edit, refuse to distribute or remove the same.

PRIVACY AND SECURITY

·          Your personal details, such as name and email address, will not be passed on to third parties, unless you have given your express consent.

·         Forgood will send emails to you in order to keep you updated on news, events and updates. Email security is your own responsibility. Forgood cannot be held responsible for any interference with your account caused by email hacking.

CANCELLATION AND TERMINATION

·         You can request that your account is cancelled through the Contact Forgood page or by sending an SMS with the word “DELETE” to 32197.

·         All of your content will be deleted from the site within 48 hours.

·         Forgood, in its sole discretion, has the right to suspend or terminate your account and refuse any and all current or future use of the site, or any other Forgood service, for any reason at any time. Such termination of the site will result in the deactivation or deletion of your account or your access to your account, and the forfeiture and relinquishment of all content within your account.

GENERAL CONDITIONS

·         Your use of the site is at your sole risk. The service is provided on an 'as is' and 'as available' basis.

·         Technical support is only available to registered members and is accessible via the Contact Forgood page. We try to respond within 48 hours.

·         You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the site, use of the site, or access to the site without the express written permission of Forgood.

·         We may, but have no obligation to, remove content and accounts containing content that we deem in our sole discretion to be unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable or that violates any party's intellectual property or these Terms and Conditions.

·         Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Forgood member or Forgood employee will result in immediate account termination.

·         You understand that the technical processing and transmission of the site, including your content, may be transferred unencrypted and involve a) transmissions over various networks; and b) changes to conform and adapt to technical requirements of connecting networks or devices.

·         You must not upload, post, host, or transmit unsolicited email, SMSs, or 'spam' messages.

·         You must not transmit any worms or viruses or any code of a destructive nature.

·         Forgood does not warrant that i) the site will meet your specific requirements, ii) the site will be uninterrupted, timely, secure, or error-free, iii) the results that may be obtained from the use of the site will be accurate or reliable, iv) the quality of any products, services, information, or other material obtained by you through the site will meet your expectations, and v) any errors in the site will be corrected.

·         You expressly understand and agree that Forgood shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages.

·         The failure of Forgood to exercise or enforce any right or provision of the Terms and Conditions shall not constitute a waiver of such right or provision. The Terms and Conditions constitute the entire agreement between you and Forgood and govern your use of the site, superseding any prior agreements between you and Forgood, including, but not limited to, any prior versions of the Terms and Conditions.

LEGAL

Forgood reserves the right, in its sole discretion, to bring proceedings against any member that we deem to be in dire breach of the above-mentioned Terms and Conditions. This Agreement shall be governed by and interpreted in accordance with the laws of your jurisdiction. 

Privacy

Personally-identifiable contact details, such as an email address or cellphone, are required to validate user sign up. A user’s email address may be used in certain instances to give notice of activities occurring within that user's account or changes and updates to Forgood’s offering. In the event of a user not wanting to receive such emails, it is possible for the user to adjust his/her privacy preferences within his/her account profile.

Forgood guarantees never to disclose personally-identifiable information to any third party for marketing, promoting or any other purpose, unless the user has given his/her knowing consent in advance, or it is required by law.

Standard web technology, known as “cookies”, may be used to store small pieces of information on a user’s hard drive. Cookies enable users to log in or fill in forms without having to enter information each time a user visits the Forgood website.

Safety

By following the Guide to Online Safety in Social Networking (as outlined below), you can protect yourself from the potential threat of ID theft, fraud, cyberbullying, cyberstalking, sexual exploitation and harassment.

1.       Make use of Forgood’s privacy features and keep your personal information personal

·         Don’t post personal details such as your name, address, email address and telephone/mobile numbers on the public pages

·         Don’t post anything about your family and friends on the public pages, they may not wish to suddenly be famous!

2.      Harassment, bullying, hate speech and other unsuitable material will not be tolerated on Forgood’s site

·         Report any abuse to Forgood and that person will be appropriately dealt with

·         Tell someone else or local law enforcement office if somebody’s behaviour towards you is persistently hostile, intimidating or inappropriate in any other way

3.      Everything you post online can be searched and saved for an indefinite time

·         Don’t post anything that you wouldn’t want anyone else, like your boss/partner/parents, to see

·         Don’t post any comments or anything that could be held against you, or come back to haunt you later in life

·         Just to be sure, always proofread your comments before making them live on public pages (even though Forgood will moderate most content)

4.      Be very careful when dealing with messages from strangers

·         Don’t become a victim of ‘phishing’, whereby a message or email will ask you to enter bank details, or other personal information, in an attempt to jeopardise your privacy or steal money from you and your family

·         Be weary of downloading and opening files that could contain viruses—make sure your computer has the right spyware installed so that viruses cannot be easily picked up

·         Never respond to SPAM messages—it only assures the message sender that your email address is in use

5.      Remember that, while it’s great to meet people online, you can never be 100% sure of who that person is

·         Don’t pass on any personal information to people you haven’t met offline before

·         If meeting one of your online contacts offline for the first time, always be sure to arrange to meet in a public place

6.      Your password is your key to your Forgood account

·         Don’t share it with anyone, not even your friends

·         Try to memorize your password, rather than writing it down on a piece of paper that could get easily lost

7.      Make sure you have read and understood Forgood’s rules and ‘Terms of Use’

·         Violating them will result in your account being deleted
